Nipsey Hussle's alleged killer Eric Holder did not get his way in court.

On Thursday (Nov. 14), the Los Angeles County District Attorney's Office confirmed to XXL that a judge has denied Holder's motion to dismiss the attempted murder charges related to the two other victims that he allegedly hit when he allegedly fatally shot Nipsey Hussle in front of his Marathon Clothing Store on March 31.

A few weeks ago, Holder’s lawyers filed a motion where they argued that the Kill Zone Theory, which is a theory that includes guidelines to determine whether someone was trying to kill someone or someones in a particular area of an attack, did not apply to the two other victims and therefore should be dismissed. Apparently, a judge disagreed.

The guidelines for the Kill Zone Theory include six factors: a primary target, a type of weapon used in the criminal act, the distance between the shooter and target, proximity to other victims to target, whether victims are in an enclosed area and whether the target was moving in the attack.

With the theory in mind, prosecutors are in support of the Kill Zone Theory for their case. They argue that despite Holder allegedly targeting one victim, the fact that he was allegedly using two weapons during the shooting shows that he intended to kill everyone in a particular zone. They say that's evidenced by the fact that his initial target was not moving.

On April 2, just two days after the death of Nipsey Hussle, 29-year-old Holder was charged with one count of murder, two counts of attempted murder and one count of possession of a firearm by a felon. On May 9, Holder was indicted on the four charges by a grand jury. He was also indicted on two new counts of assault with a firearm.

Holder is currently being held at Twin Towers Correctional Facility in Los Angeles on a $6.53 million bond. The case is set to go to trial in February. If convicted, he faces life in prison.
