Nipsey Hussle's Alleged Killer Wants Two Charges Dismissed

Nipsey Hussle’s alleged killer, Eric Holder, is reportedly trying to get two of the six charges against him dismissed in his murder case.

Holder faces one count of murder, two counts of attempted murder, two counts of assault with a deadly weapon and one count of felon in possession of a firearm in the case. According to documents obtained by XXL, Holder’s defense attorney filed a motion to dismiss the two attempted murder counts. "On September 24, 2019, Holder filed a motion to dismiss counts two and four of the indictment pursuant to PC §995," the document reads.

Prosecutors argue that Holder meets all of the hallmarks of the Kill Zone Theory, and they've motioned to have his motion dismissed. The Kill Zone Theory case stipulates that six factors must be involved: a primary target, a type of weapon used in the criminal act, the distance between the shooter and target, proximity to other victims to target, whether victims are in an enclosed area and whether the target was moving in the attack.

Nipsey was shot and killed on March 31 outside of his The Marathon Clothing in Los Angeles. Holder, the alleged gunman, was charged with first-degree murder along with two counts of attempted murder, two counts of assault with a firearm and one count of possession of a firearm by a felon.

Holder has pleaded not guilty in the case and was initially represented by Christopher Darden, who was a member of the prosecution team in the 1995 O.J. Simpson trial. Darden ultimately removed himself from the Eric Holder case.

Since Eric Holder's arrest in April, he's reportedly been held in solitary confinement due to police fearing for his life. He is being held on $6.5 million bond.
