It was a scary and deadly scene in Niagara Falls, New York on the evening of Thursday, August 3, 2023, when a man was shot and killed by officers from the Niagara Falls Police Department who were responding to a report of shots being fired.

According to multiple reports from news agencies, officers arrived at an apartment complex in the 900 block of Niagara Ave, near 10th St in Niagara Falls where they were directed to a man who was holding a handgun in front of the complex.

The 53-year-old man, whose name has not yet been released by investigators, allegedly was in an altercation with a woman on the scene before firing shots at her vehicle.

Officers say that when they encountered the man, they ordered him to the gun multiple times before they allege he raised his weapon and fired on officers, hitting one of their patrol cars.

In the body cam video, you can hear officers giving the commands, along with a volley of gunshots before the man falls to the ground.

An Investigation Is Now Underway By The NYAG

As required by state law, the New York State Attorney General's office has announced they are going to investigate the shooting,

Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident.
