A Buffalo Driver Who Killed A Baby Is Charged With Manslaughter
Erie County District Attorney John J. Flynn announced that a 19-year-old Buffalo man has been charged for killing a baby. The man was driving westbound on Genesee Street when he caused an accident that caused the baby's death. Gino M. Cesar was arraigned on March 22, 2022, before State Supreme Court Justice Debra Givens. He was charged with four crimes, including manslaughter:
- One count of Manslaughter in the Second Degree (Class “C” felony)
- One count of Criminally Negligent Homicide (Class “E” felony)
- One count of Assault in the Second Degree (Class “D” felony)
- One count of Reckless Driving (Vehicle & Traffic Law violation)
On December 13, 2021, at around 8:15 pm, Cesar was allegedly speeding on Genesee Street. Authorities say he veered into the right-hand turn lane and went through a red light at Pine Ridge Road. His vehicle ran into another vehicle, causing the deadly crash that took the 6-month-old child's life. Cesar also injured another passenger in the car, who suffered a broken hip. The driver of the vehicle and another passenger received minor injuries during the accident.
Cesar is due back in court on Thursday, May 5, 2022, at 9:30 am. He is currently being held without bail.
He could face up to 15 years in prison for Manslaughter in the Second Degree, up to 4 years for the charge of Criminally Negligent Homicide, up to 7 years for Assault in the Second Degree, and up to up to 180 days for Reckless Driving.
