Under New York State law, the time constraint in place to bring a claim for personal injury is three years from the date of the accident. We don't encourage people to wait three years, though. It's important to start investigating and processing these claims earlier than that, but technically the law allows you up to three years.

I was still curious as to whether or not there were any exceptions to the three-year statute of limitations, so I asked Rich and here’s what he shared:

For minors, the clock doesn't begin to tick until they turn 18 to make a claim. If your child has been injured it's better to not let too much time pass before you take action. These municipalities, under state law, require that a notice of claim be brought within 90 days of the accident.
