We’re pretty sure everyone is familiar with the “Milly Rock” dance. Now the rapper who created the dance is suing Epic Games for allegedly using the dance in their “Fortnite” video game.

According to Variety, the Brooklyn rapper filed the lawsuit in a California district court on Wednesday. He is suing Epic Games for its alleged “misappropriation, use, and sale” of his popular dance in their “Fortnite” game.

Epic added a similar dance emote during “Fortnite’s” Season 5 and called it “Swipe It.”

David L. Hecht, who is representing 2 Milly said, “This isn’t the first time that Epic Games has brazenly misappropriated the likeness of African-American talent. Our client Lenwood ‘Skip’ Hamilton is pursuing similar claims against Epic for use of his likeness in the popular ‘Cole Train’ character in the ‘Gears of War’ video game franchise.”

It has also been mentioned that Epic Games is not the first developer to use the popular dance in its games. According to Insider and 2 Milly, the Milly Rock also showed up in 2K Sports’ basketball sim “NBA 2K18.”

2 Milly dropped his single and music video “Milly Rock” back in 2014, and it quickly gained national popularity.
