If you're caught smoking in your vehicle while children are in the car, it's now a punishable offense in Erie County.

WKBW reports the health measure, which was unanimously passed by the Erie County Legislature makes smoking illegal in the following circumstances:

1. Smoke in a vehicle with anyone under 18-years-old present.
2. Bans the sale of tobacco or nicotine-containing products in pharmacies and other healthcare institutions.
3. Bans smoking in or adjacent to NFTA bus shelters and public areas near them.

In the first 90 days of the law, violators will be given a warning. After that, the first offense carries a $50 fine, the second offense is a $100 fine, and a third offense is a $150 fine, says WKBW.
