Judge Genece Brinkley will be residing over Meek Mill‘s case for at least one more hearing after the Pennsylvania Supreme Court denied the rapper’s motion to have the judge removed from his case.

On Tuesday (June 12), TMZ reported the Supreme Court justices were split on the decision, with three voting in favor of the motion and three denying it. Justice Kevin Dougherty could have been a tie-breaker in the decision, but for reasons unknown decided not to vote.

While Justice Wecht did vote against the motion, he gave Meek and his legal team the opportunity to raise the issue again following his June 18 hearing with Brinkley. The other judges supported the motion, claiming Brinkley should have recused herself because “her continued involvement has created an appearance of impropriety that tends to undermine public confidence in the judiciary.”

Although the decision didn’t go the way Meek hoped, his lawyer, Joe Tacopina, says the rapper and his team remain hopeful that Meek will be granted a new trial. “We remain hopeful that the overwhelming amount of evidence in this case—and the Philadelphia District Attorney’s backing will prompt Judge Brinkley to grant Meek a new trial, failing which we will promptly pursue all appellate remedies available to right this terrible injustice,” he said.

Since his release from prison in April, Meek has been enjoying his newfound freedom. Most recently, the Philadelphia rapper graced the Hot 97 Summer Jam stage in East Rutherford, N.J. on June 10 to perform some of his biggest songs, including, “Dreams and Nightmares (Intro),” “1942 Flows” and “We Ball.”
